The amendment sought to enable persons, who were deemed to lack mental capacity, to consent to their deprivation of liberty through their expression of wishes and feelings. Specific attention was drawn by the parties to the decision of <a href=\"https:\/\/www.supremecourt.uk\/cases\/uksc-2012-0068\"><em>Cheshire West<\/em><\/a> that article 5 was engaged as a matter of course where a person lacks capacity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court held that the revision was compliant, and that even where full awareness of circumstances is not present, an individual&#8217;s choices and preferences should be respected as a matter of dignity. Thus, the lack of capacity does not automatically require reviews in relation to article 5. This overruled <em>Chesire West <\/em>and the test provided in that case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Key Issues<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether a lack of capacity undermines the views and expressions of opinion for approval of confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether it undermines dignity either to ignore the expression of opinion, or to give effect to the expression by those lacking capacity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether <em>Cheshire West<\/em> set out the correct standard in law for determining when confinement must be examined where the subject of the provisions lacks capacity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Meaning and significance of human dignity for the Supreme Court in the judgment of Lord Sales and Lady Simler<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[135] Where an individual lacks full mental awareness (in a factual sense) in relation to their circumstances, so that they cannot be regarded as someone with full ability to decide how they wish to be treated for all purposes, they may nonetheless be sufficiently aware of the circumstances in which they are maintained in confinement as to be able to register whether they are happy or unhappy with those circumstances and to enter protests against their treatment if they are unhappy with them. As the authorities discussed below make clear, for such individuals this is the dividing line between cases in which they consent to their confinement and those in which they do not, for the purposes of an assessment of whether there is a deprivation of liberty under article 5. <strong>It is an important line in Convention terms, since choices made by individuals with impaired understanding should be respected where possible, as an aspect of respecting their dignity as human beings. <\/strong>Whether someone experiences the situation in which they are being kept and cared for as amounting to detention contrary to their wishes or as constituting a broadly supportive home environment where they are content to live their life is a basic aspect of human experience, and there is accordingly no good reason to disregard or discount the individual\u2019s own evaluation of their position. They may have impaired understanding of many things and may lack capacity in a full legal sense, but they may nevertheless have a fundamental understanding of whether they are broadly happy or unhappy about something so basic, and <strong>their understanding of and choices regarding that should be accorded respect<\/strong>. [emphasis added]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[138] In <a href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-189426\">Fernandes de Oliveira v Portugal<\/a> (2019) 69 EHRR 8 (\u201cOliveira\u201d), GC, a case concerning the obligations of a secure mental health hospital arising under article 2 of the Convention (right to life) to take protective measures in relation to a patient with suicidal tendencies, <strong>the European court affirmed that \u201cthe very essence of the Convention is respect for human dignity and human freedom<\/strong>\u201d: para 112. It referred in that regard to, in particular, the Convention rights in article 3 (prohibition of inhuman or degrading treatment), article 5 and article 8 (right to respect for private life). [emphasis added]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[192] A theme of the Charities\u2019 case is that because this exercise of evaluating the wishes of an individual who lacks legal capacity to consent to their care arrangements is going to be difficult or impossible in some cases, possibly even many cases, there should be no attempt to consider lack of objection or wishes and feelings in any case at all. We do not accept this. <strong>It is contrary to the fundamental principle underlying the Convention that individuals should be treated with due regard to their dignity as persons and that their own views should be accorded respect:<\/strong> paras 138\u2013139 above. It is also too crude as an approach in this area, where sensitive judgments are required. The argument that, because some adults will find it difficult to communicate and express views and feelings about their placement, the views of no adults should be capable of vouching consent creates an arbitrary threshold and may lead to unnecessary and intrusive interference with the private lives of those adults with impaired mental capacity who are able to express views and feelings.
