This helped challenge some common misconceptions surrounding the term. Positive action is not the same as positive discrimination, for example recruiting only based on characteristics, quotas (vs targets), schemes that benefit a group without evidence that they are disadvantaged. Positive action is also not the same as broader inclusive or accessibility-focused actions.

We then shifted into the discussion with Jen and Caroline, who shared their experiences of within the University of Exeter and the Met Office. Both speakers noted a wide range of inclusive actions are routinely used to help ensure recruitment processes are fair and accessible for all candidates. However, the discussion showed that no one had encountered positive action itself in practise.

Examples for inclusive actions included:

Reviewing job advertisements to remove biased language

Advertising vacancies through a broad range of channels to reach diverse audiences.

Anonymising applications and using candidate numbers during assessments.

Ensuring interview panels are diverse.

Using consistent scoring criteria based solely on evidence provided in applications and interviews.

Providing recruitment guidance, checklists and training for hiring managers and panel members.

They also covered some inclusive practices that support employees once they have joined the organisation, including:

Family friendly policies such as core meeting hours between 9:30-15:00, hybrid working arrangements and support for employees returning from parental or other forms of leave.

Buddying, mentoring and networking opportunities that help foster inclusion and career development.

Jen shared her experience implementing a single-gender shortlist policy, whereby shortlists should not consist entirely of candidates from one gender. This does not mean swapping out one or more candidates (more on this below). This sparked an interesting discussion about how such a policy works in practice, particularly where anonymised recruitment processes are used. Jen explained that where a shortlist contains candidates from only one gender, organisations may need to review earlier stages of the recruitment process. This could involve assessing whether the job advertisement contained unintended bias, whether it was advertised in the most appropriate locations, or whether a new recruitment campaign may be required to attract a broader pool of applicants. In some cases, organisations may also choose to expand the number of interviewees to ensure a more diverse shortlist.

Both Jen and Caroline reflected on their experiences of recruitment and noted that they had not encountered the discussed “tie-breaker” scenario. They explained that candidates almost never have identical qualifications, skills and experience, meaning hiring decisions or ‘tie-breaker’ scenarios where 2 candidates score equally are based on the evidence presented during the recruitment process rather than positive action provisions.

One of the most useful takeaways from the event was the distinction between positive action and inclusive action. Many attendees commented that they had previously assumed the two terms were interchangeable. Through the presentations and discussion, it became clear that positive action is a specific legal mechanism that requires evidence, justification and careful implementation, while inclusive actions are broader measures that can be embedded throughout recruitment and workplace practices to create a fairer and more accessible environment for everyone. The event provided a valuable opportunity to learn from colleagues with practical experience of recruitment and inclusion. It also encouraged thoughtful discussion about how organisations can continue to remove barriers particularly during recruitment.

References:

Positive action in the workplace –
